The public hearing on the extension of the 1041 permit application for Nestlé Waters North America Inc. has been formally set for 1 p.m. Tuesday, Oct. 20, 2020, to be held in the Community Center, located at 715 E. Main Street, Buena Vista.

If the  Community Center is not open to the public due to COVID-19 pandemic developments, it will be held in the Commissioner’s Meeting Room, 104 Crestone Ave., Salida. Nestlé, located at 12974 Hwy 24/285, Johnson Village, 22565, and TBD CR 300, Nathrop, is seeking renewal of its 1041 permit for another 10 years. The extension permits the company to pump spring water for its production process, covers its associated transmission pipeline from the spring to its storage facility in Johnson Village, and its loading facility.

The first 1041 state permit was issued in 2009, allowing Nestlé to pump spring water from its springs in Chaffee County, covering its production process, associated transmission pipeline, and loading facility for its bottled water production facility in Denver.

The permit was originally due to be reviewed in Dec. 2019. But the public hearing has been postponed multiple times, first due to meeting proper legal notice requirements, then due to COVID-19. Nestlé is currently operating under a permit extension through Dec. 2020.

Nestlé Waters North America, Inc. is a business unit of Nestlé Waters that produces and distributes numerous brands of bottled water across North America. Continent-wide brands include Perrier and San Pellegrino.

According to a county press notice, all interested persons are encouraged to attend one of the public hearings or submit a statement with opinions and comments on the proposed land-use change.

It is important for members of the public to note that it is inappropriate to personally contact individual County Commissioners or Planning Commission members while an application is pending. Such contact is considered ex parte communication and will have to be disclosed as part of the public hearings on the matter.

Those with concerns should contact county staff, write a letter or present your concerns at the public meeting so your comments can be made part of the record.

The county clarifies that those wishing to use a representative to present comments, that it is more persuasive to provide written authorization for that person to represent you.

The county also publicly points out that “approval of the subject application or development may result in the establishment of a vested property right”.
